The <a href="http://thinkprogress.org/2009/11/10/robertson-muslim-fascist/" target="_blank">mental midgets</a> are hell-bent on displaying their idiocy for all to see. Why do we tolerate these parasites?</p>
<p style="text-align:left;">Last Thursday, a US Army psychologist decided that he was going to play one-man jihad at Fort Hood. This man was a US citizen, born of Jordanian immigrants, who happened to be a practicing muslim. Early reports indicate that his religion was part of what made him kill a dozen people and wound dozens more.</p>
<p style="text-align:left;">Well, the professional whackjob class in this country has been trying to use this man&#8217;s savagery to justify their own xenophobia and parochialism. That expert in all things, Pat Robertson, opined that Islam was not a religion but a political movement, and it would therefore be acceptable to discriminate against and persecute people based on that fact.</p>
<p style="text-align:left;">I&#8217;ll allow that to sink in for a moment.</p>
<p style="text-align:left;">In other words, a well-known and influential cleric has called for persecution of a large group of people because they do not believe as he does. Had he been wearing robes and speaking in a mosque, this man would be the focus of intense scrutiny from US intelligence agencies. Since he was wearing a suit and speaking in a megachurch, nothing will happen to him. Am I the only person who sees that as unjust?</p>
<p style="text-align:left;">Worse still, this pompous ass-hat is also of the opinion that persecution of and discrimination against people with different <em>political</em> views is a good thing. Perhaps Mr. Pat &#8220;<em>I look like Yoda</em>&#8221; Robertson hasn&#8217;t thought his cunning plan all the way through. If it is generally okay for people to persecute and discriminate against people with different religious and political views, <em>he</em> is going to be on the receiving end of a lot of that. I&#8217;m pretty sure even Regent University teaches basic math. Perhaps Robertson could get one of his graduate students to stop praying long enough to fill him in on the demographic results of the last general election. Robertson and his xenophobic right wing brethren are <em>not</em> in the majority in this country. Mr. Robertson, you <em>really</em> do not want to open that particular can of worms.</p>
<p style="text-align:left;">Let us take a look at some other basic facts, shall we? Most muslims living in the US are a fairly liberal bunch. The only real difference between an American who is muslim and one that is not is faith, which is a private matter. There are millions of muslims in this country who are doing nothing more or less than living the American Dream, and have no plans for anything more than that (except perhaps completing the <em>Haj</em>). There is no reason to treat them as anything other than fellow citizens &#8230; unless you&#8217;re a right-wing bible-thumper with a TV show and a bad hairpiece.</p>
<p style="text-align:left;">Many Americans deal with muslims every day in this country. You can find them where you work, in schools (except Regent University, obviously), and where you shop. They are just <em>people</em>- no more, no less. Singling them out for their religious beliefs is not merely wrong- it&#8217;s stupid. Who else will Mr. Robertson and his cadre of christian fuckwits single out for persecution? Red-heads? Lefties? Touch-typists? Unibrows? People who use Macs?</p>
<p style="text-align:left;">I have a better idea: let us all join forces to persecute and discriminate against Pat Robertson and all of his followers for their religious and political beliefs. After all, they&#8217;re in the minority. No violence- just refuse to do business with them. &#8220;Sorry, Mr. Robertson. I cannot take care of your lawn because you are a stupid, racist windbag.&#8221;</p>
<p style="text-align:left;">This past weekend, I came across a nice Persian family while shopping at Sam&#8217;s Club. They were jabbering away at each other in Farsi (which I recognize but cannot speak), and the mother was wearing a <em>hijab</em>. The two kids were acting like kids, and I walked past them while the little boy was standing up in the shopping cart going, <em>vrooom! vrooom!</em> As I passed, I grinned widely at his father, to express my amusement at his son&#8217;s antics. I had no idea whether or not he spoke English (I assume he did, but don&#8217;t know), but we shared a brief communication despite the lack of words: I was amused by the boy&#8217;s vrooming, and he was pleased and proud of his kid (judging by the smile and head shake I got in return). Just two people getting a kick out of a little boy playing racecar from inside a shopping cart.</p>
<p style="text-align:left;">Despite the fact that I do not speak Farsi, and my religious beliefs are essentially non-existent, I would far rather have this unknown man and his family as fellow Americans than a jackass like Pat Robertson.</p>

<p style="text-align:left;">In yet another example of how far astray from its alleged purpose our &#8220;justice&#8221; system has wandered, <a href="http://www.google.com/hostednews/ap/article/ALeqM5hitISYixOv_DC0ABZeYzc6dg2BDAD9BRL12G0" target="_blank">here</a> are a <a href="http://www.truthout.org/1109094" target="_blank">couple</a> of <a href="http://www.cnn.com/2009/CRIME/11/06/lapin.wrongful.conviction/" target="_blank">articles</a> about some journalism students at Northwest University getting harassed by an Illinois prosecutor. Their crime? Glad you asked. It turns out that a Journalism professor at Northwest has, for the last ten years or so, tasked his advanced students with learning if anyone currently in prison might actually be innocent. Evidence uncovered by these student-journalists is turned over to the relevant attorneys, and a total of eleven innocent men have been freed as a result of their efforts. This has apparently raised the ire of the Illinois State Attorney, who seems to be trying to intimidate the students and their professor by launching an investigation into &#8230; the students&#8217; grades.</p>
<p style="text-align:left;">I&#8217;m reasonably certain that somewhere in a prosecutor&#8217;s job description it is written that <em>justice</em> is the goal. Far too many prosecutors seem to have forgotten this, judging by the extravagant mental gymnastics several prosecutors have used recently in attempts to keep demonstrably innocent men in prison.</p>
<p style="text-align:left;">Despite the supposed focus on justice required by their jobs and oaths of office, far too many prosecutors across the country are more interested in their conviction ratio. The more convictions they get- especially in high-profile cases- the more pay and bennies they earn. This is doubly true for those prosecutors who are elected to their offices.</p>
<p style="text-align:left;">For those of you who failed to pay attention in civics class, here&#8217;s a hint: Prosecutors are public servants. We (the People) are the public. I fail to see how we are being served by political hacks more interested in promotions, re-elections, and pay raises than in justice.</p>
<p style="text-align:left;">Back to the case at hand. A prosecutor, when given evidence that someone has been wrongfully convicted and sent to prison, should examine the evidence, re-examine the case in light of the new evidence (if it has any value), and either get the convict a new trial or immediately get him or her released from prison. Alas, this ideal state does not exist except (possibly) on paper. In reality, prosecutors have been trained that more convictions means more money and power for the prosecutors, so penny-ante subjects like the actual innocence of their victims doesn&#8217;t come into the picture.</p>
<p style="text-align:left;">I don&#8217;t know about you, but I was always told that it was better that a thousand guilty men go free than one innocent man be deprived of life or liberty. Our so-called &#8220;justice&#8221; system is <em>supposedly</em> set up with this principle in mind. It is the price of a free society. There is <em>no excuse</em> for sending innocent men or women to prison. If there is a reasonable doubt, they must be found &#8220;not-guilty&#8221; (note that this is not necessarily the same as <em>innocent</em>). If they have already been convicted and sentenced, the presentation of new evidence which may provide &#8220;reasonable doubt&#8221; must be looked at dispassionately by judges, prosecutors, and defense attorneys alike with justice in mind. If the new evidence had been presented at trial, would this convict have been found guilty? Does this evidence provide &#8220;reasonable doubt&#8221; of the convict&#8217;s guilt? These are matters of Law and Justice, and the political status and professional pride of the prosecutor should have no bearing on the decision.</p>
<p style="text-align:left;">I am a firm believer that some crimes merit the death penalty. That said, the death penalty must <em>only</em> be invoked for truly heinous crimes about which there is <em>no doubt</em> of guilt. Not &#8220;reasonable doubt&#8221;- no doubt whatsoever. A sentence of death should be a separate decision from that of guilt or innocence, and <em>any</em> doubt should immediately drop the maximum penalty to that of life imprisonment without possibility of parole. Given the shenanigans prosecutors around the country have been pulling lately, a blanket suspicion of doubt has effectively been cast over <em>all</em> convictions. The actions of a few prosecutors are tainting the very heart of the judicial process. If prosecutors are willing to allow innocent men and women to languish in prison or even be put to death if it might further their career, then the criminal justice system in this country is broken beyond repair.</p>
<p style="text-align:left;">And now, we return to my catch phrase: the Four Boxes. There are four boxes which must be used- in the following order- in defense of liberty. These are Soap, Ballot, Jury, and Ammo. This subject demands that we (the People) use those first three boxes to correct these injustices, now and forever. If we fail to immediately and permanently deal with the application of injustice by our public servants with those first three boxes, then our Republic is doomed. We will be forced to open that Fourth Box, in the aftermath of which the United States of America will be no more.</p>
<p style="text-align:left;">So, start paying attention. Use that sloppy grey goo between your ears for a change. Take the time to learn the facts for yourself, from multiple sources whenever possible. When you find the putrid smell of injustice, root it out. We cannot afford to let it fester, for that way lies madness and destruction.</p>

<p style="text-align:left;">You may remember the <a href="http://www.foxnews.com/story/0,2933,572917,00.html?test=latestnews" target="_blank">tale</a> of a Minnesota family whose mentally-deficient 13 year old son was diagnosed with Hodgkins Lymphoma. The doctors told the family that the child had a 95% chance of surviving with a regimen of chemo and radiation. The prognosis without the treatment was death. Sounds like a no-brainer, right?</p>
<p style="text-align:left;">Sadly, &#8220;no brainer&#8221; describes the mental acuity level of this particular family of dipshits. The deeply religious family thought their kid was some sort of prophet, and refused to allow him to get treatment based upon their religious beliefs. The doctors told the state government, who promptly hauled the family into court. The court told the family that they must provide the required life-saving medical treatment, regardless of their religious beliefs.</p>
<p style="text-align:left;">Mom took the kid on the lam, making a run for Mexico with a side-trip into northern California. Those of you with any familiarity with the geography of North America may wonder about this- there is a fairly straight course from Minnesota to Mexico that doesn&#8217;t come within 500 miles of California. It turns out that mom wanted to take her &#8220;prophet&#8221; son to some woo-woo witch doctor type in northern California- hence the detour.</p>
<p style="text-align:left;">They got caught, and were duly hauled back home and forced to take the child in for his godless treatment. He had his last round of treatment on Friday, and the tentative prognosis is very good. The docs will do some follow-up tests in a few months to make sure the lymphoma is completely gone, but he appears to be cancer-free at the moment.</p>
<p style="text-align:left;">This is one of the rare success stories, when rationality wins out over woo. All too often, the victim of these outdated religious ideas will be discovered too late for survival. The parents are then hauled off to prison wailing that it was &#8220;god&#8217;s will&#8221;.</p>

<p style="text-align:left;">Sadly, those who would rather believe than know are still out there, many of them in positions of authority. Case in point: an Iraqi Major General in charge of security for Baghdad just loves his <a href="http://www.nytimes.com/2009/11/04/world/middleeast/04sensors.html" target="_blank">expensive woo-woo bomb detectors</a> &#8230; which do not work. They have been proven to not work. With US military personnel no longer manning the checkpoints, the Iraqi troops have been using these ADE-651 devices in an attempt to keep bombs out of the streets. Security camera footage has shown that the recent bombings in Baghdad went right through the checkpoints &#8220;guarded&#8221; by troops using these devices, but the General in charge won&#8217;t budge.</p>
<p style="text-align:left;">The US has tested these things, and proven that they don&#8217;t work. James Randi has issued a one million dollar challenge to the British company that manufactures and sells these toys. If one ADE-651 successfully detects explosives in a scientific double-blind study, Randi&#8217;s foundation will give them a million dollars.</p>
<p style="text-align:left;">It must be noted that the company selling these ineffective, high-tech diving rods, ATSC(UK), is making money hand over fist selling their twaddle to third-world security forces. Iraq has ordered more than thirty-two million dollars worth of ADE-651s from ATSC, despite complaints from the US government and military.</p>
<p style="text-align:left;">“<em>I don’t care about Sandia or the Department of Justice or any of them</em>,” General Jabiri said. “<em>I know more about this issue than the Americans do. In fact, I know more about bombs than anyone in the world</em>.”</p>
<p style="text-align:left;">Here we have a case where people&#8217;s lives are being put at risk by a belief in magic- or rather, a lack of belief in scientifically-proven evidence. In fact, 155 people lost their lives due to the faith placed in these &#8220;magic&#8221; devices.</p>
<p style="text-align:left;">If one were to be crude, one could wave aside General Jabiri&#8217;s foolish faith in the ADE-651 as the parochial stupidity of a third-world peasant. One would be wrong to do so. High-ranking officers in most Arab countries are generally highly-educated members of politically-powerful families with close ties to the government. General Jabiri is not an illiterate peasant, but he still has more faith in woo than in reproducible results and hard evidence.</p>
<p style="text-align:left;">General Jabiri and those American families who have permitted their children to die rather than get medical assistance because of their faith are evidence of a global gap in understanding of science. Even highly-educated people from well-to-do families and well-off middle class Americans are choosing to have faith in thousand-year-old religious texts or palm reading or dowsing or astrology or equally nonsensical ideas. Why?</p>
<p style="text-align:left;">I think mental laziness is to blame. Understanding modern science is hard work. It requires a willingness to read science articles and ask questions about what has been read. It requires the ability to unlearn old falsehoods. It requires being able to say, &#8220;I don&#8217;t get it&#8221;. These are all tough to do for many people. On the other hand, believing in a magic rock which protects you from getting eaten by a tiger is easy. Religion as a concept encourages its followers to blindly accept many things for which there is no evidence. People who can believe that a galactic overlord dropped the bodies of criminals into Hawaiian volcanoes several million years ago and then nuked them (for example) will probably have little difficulty believing six other impossible thongs before breakfast.</p>
<p style="text-align:left;"><em>God is omnipotent, omniscient, and omnibenevolent—it says so right here on the label. 			<content:encoded><![CDATA[<div class='snap_preview'><br /><p style="text-align:left;">Argh! The stupid, it <em>burns</em>!</p>
<p style="text-align:left;">I&#8217;ve spoken at length about the Four Boxes to be used in defense of Liberty. Those are Soap, Ballot, Jury, and Ammo, and should be used in that order. The purpose of that saying is to discourage people from resorting to violence when peaceful methods are available- and more likely to produce positive results without a lot of unnecessary collateral damage to society. Implicit in that description is the idea that, at some point, the destruction of liberty becomes so onerous that nothing less than a total write-off and re-build is in order. If the justice system (Box #3) in this country stops actually providing justice, there will be little recourse but to wipe the slate clean and start over.</p>
<p style="text-align:left;">There is a case being heard before the Nine Worthies right now that has the potential to push the country over that particular precipice. Here is the <a href="http://www.npr.org/templates/story/story.php?storyId=120069519&amp;scum" target="_blank">story from NPR</a>- just take care your blood pressure does not reach dangerous levels while reading it.</p>
<p style="text-align:left;">Worse than the initial criminal actions by the prosecutors and police in the original case is a single quote from the prosecutors- backed up by the Attorney General of the United States, no less: &#8220;<em>There is no free-standing Constitutional right not to be framed</em>&#8220;</p>
<p style="text-align:left;">Pop quiz time: Can anyone point to any part of the US Constitution which might give lie to this assertion by trained legal professionals? Anyone? Buehler?</p>
<p style="text-align:left;">Let us take a look at the Fifth Amendment, shall we?</p>
<p style="text-align:left;"><em>No person shall be held to answer for a capital, or otherwise infamous crime, unless on presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, <strong>without due process of law</strong>; nor shall private property be taken for public use, without just compensation.</em></p>
<p style="text-align:left;">That seems to pretty definitively send the prosecutors&#8217; argument into the shitcan where it belongs. The two men in question did not receive due process. They were maliciously framed by the police and prosecutor. Due process of law wasn&#8217;t even allowed in the courtroom.</p>
<p style="text-align:left;">The main issue seems to be Prosecutorial Immunity. Long-standing legal precedent holds that prosecutors cannot be held civilly liable when a case goes south on them. This is largely in place to protect prosecutors from civil penalty if they inadvertently convict the innocent. The prosecutors (who still claim that Terry Harrison and Curtis McGhee committed the crime in the face of really impressive evidence to the contrary) are trying to convince the Supreme Court that the Public Interest would be harmed by allowing any variation from the doctrine of Prosecutorial Immunity.</p>
<p style="text-align:left;">That&#8217;s as may be, and I could not care less. Two <strong><em>completely innocent men</em></strong> were framed by a Prosecutor and the police, and spent twenty-five years in prison as a result. I submit that the Public Interest is harmed far more by allowing prosecutors to withhold evidence and suborn perjury. The evidence for this assertion is simple and clear: If prosecutors can commit felonies with impunity against the very public they allegedly serve, our justice system (and the Republic on which it is based) is no more. The Supreme Court is the last resort for those who have worked their way through the first three Boxes. If the final appeal from the Third Box rules against the innocent victims, what choice do we (the People) have left?</p>
<p style="text-align:left;">The Supremes will probably issue a ruling on this early next year. I hope that they will rule in the interests of Justice over the interests of the rules and procedures. Reading past rulings lends a certain degree of hope that they will, but another chilling quote from a sitting Justice makes me fear the worst (&#8220;<em>Mere factual innocence is no reason not to carry out a death sentence properly reached.&#8221; &#8211; Supreme Court Justice Antonin Scalia</em>). If the Court rules in favor of the prosecutors, that&#8217;s it- game over. Such a ruling would mean that we are no longer free citizens, but serfs. Slaves to the Government, to be imprisoned at the whim of Government functionaries. If the Government fails to &#8220;establish Justice&#8221;, and &#8220;secure the blessings of Liberty&#8221;, it will be time to vote from the rooftops.</p>
<p style="text-align:left;">And that would be the end of the United States of America.</p>

<p style="text-align:left;"><strong>BAREFOOT BUM</strong></p>
<p style="text-align:left;">A couple of months ago, the <a href="http://barefootbum.blogspot.com/" target="_blank">Barefoot Bum</a> abruptly closed his blog. He said that he&#8217;d run out of things to say. Fortunately for rational discourse, he has recanted that decision and returned to the fray. Please give him a read. I rarely agree with him politically, but he always makes well thought-out and supported arguments. This is such a rare commodity among internet denizens that we should all take notice- whether or not we agree with his conlusions.</p>
<p style="text-align:left;">
<p style="text-align:left;">
<p style="text-align:left;"><strong>IF YOU TAX THEM, THEY WILL LEAVE</strong></p>
<p style="text-align:left;">There&#8217;s an excellent article over at <a href="http://www.city-journal.org/printable.php?id=5433" target="_blank">City Journal</a> describing the demographic penalties for high-tax states in comparison with low-tax states. The two primary comparisons are between Texas and California. I have a few issues with some of the author&#8217;s unspoken assumptions, conclusions, and methodology, but the trendline does appear to be significantly in favor of the states with lower taxes.</p>
<p style="text-align:left;">
<p style="text-align:left;">
<p style="text-align:left;"><strong>SPEAKING OF VOTING WITH ONE&#8217;S WALLET &#8230;</strong></p>
<p style="text-align:left;">The wife and I have abandoned our previous internet and TV service provider in favor of two competing services whose aggregate payments are roughly 1/3 cheaper. While I&#8217;m on the subject, we&#8217;re saving better than a hundred dollars a month by moving out of our apartment and into our own house. All told, our monthly outlays will be reduced by about 25% because of this move- despite the added costs of sewer, garbage, and water.</p>
<p style="text-align:left;">How did we do it? Simple. We refused to settle for less than what we wanted for the money, we were willing to wait for the right circumstances, we&#8217;re willing to put in sweat equity, and we are not averse to paying for quality. We got a roughly $150K house for only $120K.</p>
<p style="text-align:left;">
<p style="text-align:left;">
<p style="text-align:left;"><strong>QUALITY, AND THE VALUE THEREOF<br />
</strong></p>
<p style="text-align:left;">My wife and I did a lot of shopping around for goods and services for our new house. Consumer Reports was very useful in determining which appliances to buy, and some of the companies who submitted winning bids on the modifications and upgrades we wanted recommended other companies for specialty work. Note that the winning bids were not necessarily the lowest bids. I value quality workmanship at least as much as cost. One company showed up to do some electrical work within 20 minutes of our phone call, performed admirably and professionally, and charged a modest fee. Since this company also performs plumbing and other work, we&#8217;ve hired them more than once.</p>

<p style="text-align:left;">
<p style="text-align:left;"><strong>EFFICIENCY</strong></p>
<p style="text-align:left;">Usually pays off over time. In the case of some of our upgrades, we&#8217;re reaping dividends in the short term as well. Our top-end HVAC system is returning us approximately $4,300.00 in tax credits and rebates. All you have to do is learn the rules and exercise the grey material between your ears. Yes, Virginia, there<em> is</em> math involved.</p>
<p style="text-align:left;">Whenever a salescreature begins extolling the efficiency of his or her overpriced product of choice, calculate out how long it would take for the efficiency savings to pay for the higher price. Unless the product has a lifespan measured in decades, a return on investment time of 5 years or more is probably not worth it.</p>
<p style="text-align:left;">Your mileage may vary. Not sold in stores. Consult a physician or lawn-care professional before using. Offer void in Alaska, Hawaii, and parts of Tennessee.</p>
<p style="text-align:left;">
<p style="text-align:left;">
<p style="text-align:left;"><strong>SAMHAIN</strong></p>
<p style="text-align:left;">One of the happier memories from my childhood was Halloween. These days, however, various strange bedfellows are working in concert (perhaps inadvertently) to destroy happy memories of the holiday for the current generation of kids. Wiccans, rabid evangelical christians, and helicopter parents all have their collective panties in a twist about Halloween.</p>
<p style="text-align:left;">Here in the Shallow South, the fundie-loonies are all up in arms over the supposed satanic nature of Halloween. Schools in this area can&#8217;t even refer to October 31st as Halloween. Now it&#8217;s the Fall Festival. It shouldn&#8217;t be a surprise that the evangelical wingnut fringe is making these claims- they don&#8217;t even know what&#8217;s in their sacred texts, so why should I think they&#8217;d be willing and able to read history and anthropology?</p>
<p style="text-align:left;">The helicopter parents at least have a few fragments of rationality behind their phobia against permitting their precious snowflakes to go trick-or-treating. There really are bad things which could happen to the puir wee bairns. The fact that a few basic precautions can eliminate or at least dramatically minimize the (already low) probability of those Bad Things happening has apparently not entered the vacuous skulls of the pathologically overprotective. So their crotch-goblins miss out on the fun of pretending to be goblins. Don&#8217;t worry- I&#8217;m sure the helicopter parents will pay for their paranoia, probably in the form of payments for the services of child psychologists.</p>
<p style="text-align:left;">Those wacky Wiccans are the real wild cards in the mix. For some reason, some Wiccans are upset that <em>their</em> holiday is being usurped by common folk for non-religious reasons. In my experience, Wiccans  are generally very tolerant of the real world around them. It&#8217;s disturbing to learn that even pagans have fundamentalist whackjobs.</p>

<p style="text-align:left;">
<p style="text-align:left;"><strong>MEANWHILE, BACK IN WHAT PASSES FOR REALITY &#8230;</strong></p>
<p style="text-align:left;">&#8230; the police in San Jose, California, are escalating the general assault on the civil liberties of the citizens they allegedly serve. Apparently, police in that city have been arresting tons of people for the crime of &#8230; wait for it &#8230; resisting arrest. Furthermore- and this will shock you- the internal police department investigations into citizen complaints about this practice have found that the officers did not violate procedure.</p>
<p style="text-align:left;">Somebody call the Supreme Court. I&#8217;m reasonably certain that &#8220;dissing a cop&#8221; is not a valid criminal offense.</p>

<p style="text-align:left;"><strong>IN THE LATEST NANNY-STATE NEWS</strong></p>
<p style="text-align:left;">Some jackass-in-office in Ayer, Massachusetts got perturbed at the sight of a father pushing his kid on a swing while smoking. Outdoors. In public. How horrible! As a result, the stalwart city leaders of Ayer have banned smoking in all parks and public lands within their jurisdiction.</p>
<p style="text-align:left;">I don&#8217;t smoke, but the idea doesn&#8217;t fill me with horror or loathing either. I seriously doubt that anyone outdoors is likely to be exposed to hazardous levels of second-hand smoke unless they were literally nose-to-nose with the smoker. Simply walking a meter or so in any direction would reduce the potentially toxic emissions from the smoker to negligible levels- well below the maximum threshold value from the NIH. As a practical matter, the general level of toxins already in the atmosphere in most major metropolitan areas make second-hand smoke one of the safest pollutants to breathe. Of course, I&#8217;m talking about practicality in reference to a state founded by a bunch of bandy-legged, redneck, militia types (also known as Puritans). Logic and practicality never come into play when the chance arises to punish someone for enjoying himself.</p>
<p style="text-align:left;">Isn&#8217;t it about time we (the People) told the officious busybodies who supposedly work for us to keep their noses out of our business?</p>

In my job, I am regularly in contact with self-important buffoons who believe their &#8220;exalted&#8221; status makes them immune to the laws of physics and/or common courtesy. I delight in verbally demolishing these popinjays to their faces, shredding their self-importance and snobbery with only facts and logic. I never use foul language, and I always preface my attacks with the appropriate honorifics. For a far better example of how to accomplish this, please read <a href="http://etext.virginia.edu/toc/modeng/public/RosCyra.html" target="_blank">Cyrano de Bergerac</a>.</p>
<p style="text-align:left;">Even better are those times when the object of torture commits his or her nonsense to paper or email. In these circumstances, I can take the proper time to slowly and clinically cut the offender off at the knees. In the latest of these situations (this morning), one of my supervisors (who received a copy of my reply) took the time to call me on the phone and express his delight at the way I handled the matter.</p>
<p style="text-align:left;">I can therefore appreciate those who have far more skill in this endeavor than I. Case in point (pun intended): the verbal and legal smackdown  laid upon &#8220;birther&#8221; maven Orly Taitz (yes, that <em>is</em> her real name). This combination attorney, dentist, and interior-decorator (you just <em>wish</em> I was joking) has been filing frivolous lawsuits in Federal court in a ludicrous attempt to force the President to produce his birth certificate- presumably in her spare time from being Carol Channing&#8217;s stunt double (OK- that was a joke. Sort of. Check out her picture).</p>
<p style="text-align:left;">I&#8217;ll not dignify her delusions with evidence to the contrary. That has been done by others so often and so thoroughly that it need not be repeated here. Suffice to say that the Courts have been tossing out her ridiculous claims with mind-numbing regularity.</p>
<p style="text-align:left;">After the most recent mauling in the middle district in Georgia, she was informed by the Court that her actions constituted frivolous filings, and she was ordered to show cause why the Court should not sanction her to the tune of $10,000. Just to show you how far off into moon-bat land she is, Ms Taitz immediately filed <em>another</em> frivolous motion- this time demanding that the judge recuse himself.</p>
<p style="text-align:left;">The Court took the time to thoroughly and humiliatingly detail every aspect of this wingnut&#8217;s nonsense in a 43-page smackdown, ending up with fining her $20,000 for essentially being stupid in court. Please take the time to read the <a href="http://washingtonindependent.com/63558/orly-taitz-sanctioned-for-20000" target="_blank">court&#8217;s order</a>. I am impressed. Note that the Court made sure to completely itemize the sanctionable actions of this wombat to make sure any Apellate Court jurist has a clear picture of just what sort of whackjob they&#8217;re dealing with.</p>
<p style="text-align:left;">By the way, the Court also ruled on this sanction <em>sua sponte</em> (on its own- without being asked to do so by opposing counsel). Lawyers do get sanctioned, but generally not without a request by their opposite number in a case. This judge took the very rare step of imposing sanctions without any such request.</p>
<p style="text-align:left;">Stuff like this gives me hope. I feel a lot less alone when I face down the hordes of mindless drones who infest my working days after reading this legal pimp-slap.</p>

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p style="text-align:left;">I&#8217;ve written before on the subject of police abuses. More and more frequently, news stories appear which paint a picture of police organizations across the country treating the citizens they allegedly serve as criminals. Here is another <a href="http://www.courthousenews.com/2009/09/23/Family_Says_911_Tape_Caught_Cops_Planning_Cover-Up_After_Shooting.htm?=protectandserve" target="_blank">horror story</a> from Phoenix, Arizona.</p>
<p style="text-align:left;">It turns out that a homeowner was forced to react when a stranger crashed into his house through the front window and ran into his child&#8217;s bedroom. The homeowner grabbed his gun, held the bad guy at gunpoint, and called the police. The cops arrived while he was still on the phone with 911, so the homeowner&#8217;s wife went outside to tell the police that her husband had the bad guy at gunpoint. Somehow, this information didn&#8217;t sink in. The first officer through the door shot the homeowner <em>in the back</em> four times, then shot him twice more- in the back- while he lay on the ground.</p>
<p style="text-align:left;">Another officer came in and told the first cop that he had just shot the homeowner- the completely innocent party who was still on the phone with 911. The 911 recording picked up the police officers as they immediately began to try and cover up what had happened. The first officer was asked where the homeowner&#8217;s gun was. He replied, &#8220;<em>I don&#8217;t know. I didn&#8217;t see a gun</em>.&#8221; The other officers took the time to let the first officer know that they had his back. All of this was recorded by the 911 operator, as were the innocent victim&#8217;s pleas for his family to be spared seeing him like this.</p>
<p style="text-align:left;">In lieu of providing first aid or doing anything rational, the police dragged the innocent victim by his injured leg out onto the patio in front of the man&#8217;s wife and kids. He was then searched, handcuffed, and laid onto the hood of a patrol car- which then drove several houses down the street with the wounded man on the hood. When medical care finally arrived, the victim was transported to the hospital, but the police refused to allow his family to learn anything about his condition. To everyone&#8217;s surprise, the homeowner did survive, but will be in pain for the rest of his life as a result of his injuries. <a href="http://vvoice.vo.llnwd.net/e14/3165246.0.pdf" target="_blank">A lawsuit is pending</a>.</p>
<p style="text-align:left;">Despite the evidence of the 911 recordings, the police involved in this fiasco swore that the first officer had been threatened by the homeowner&#8217;s gun and had fired in self-defense. I&#8217;m sure that explains the multiple gunshot wounds in his back, and the first cop saying that he hadn&#8217;t seen a gun. A police department shooting review board decided that the police did not violate department policy in this shooting.</p>
<p style="text-align:left;">I&#8217;ll let that one sink in for a moment.</p>
<p style="text-align:left;">The police department apparently thinks it is perfectly within department policy for officers to burst into a home and shoot the first black or brown person they see. In the back. The officers in question were not reprimanded or punished in any way. As far as I can tell, they are still working for the Phoenix Police Department.</p>
<p style="text-align:left;">I would love to say that this sort of behavior is atypical, and that police departments do not routinely cover up for their officers who act in such a fashion. Since I don&#8217;t feel like lying, I cannot say this. These abuses are becoming more and more commonplace across the country. The police- who work for us- are treating us like the enemy.</p>
<p style="text-align:left;">This police behavior worries me (and it should bother everyone) because I can see this sort of thing happening where  I live. The local police are not known for their professionalism, but they are known for circling the wagons at the first sign of civilian unhappiness with their actions. This is unacceptable. Police are hired by the public to enforce the laws. Period. Full stop. We, the People, have granted the police broad authority to accomplish this task. Far too many police agencies do not have any sense of responsibility to go along with their authority. It is therefore incumbent upon us- the people who hired them- to enforce responsibility.</p>
<p style="text-align:left;">I suggest setting up police review boards along the lines of jury duty. Members of the community can be called up to serve for a month on a police review board. This board will examine every complaint against the police during that month, and provide binding decisions. The police department will be required to enact the decisions of the board within 60 days. A criminal court judge would oversee police completion of Board decisions, and apply judicial penalties for noncompliance.</p>
<p style="text-align:left;">This brings me back to the Four Boxes. This proposed program requires the use of the first three boxes. Use a Soap Box to advocate for this sort of civilian oversight. Use the Ballot Box to vote for this sort of program and for politicians who support it. Use the Jury Box to enforce compliance with the program. If we do all of that, we might be able to avoid opening that Fourth Box.</p>
<p style="text-align:left;">If we keep on going the way things are going now, we get closer and closer to opening that Fourth Box. Nobody wants that.</p>

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p style="text-align:left;">For those of you who&#8217;ve just awakened from a coma, the US held a General Election last year in November. The new President was duly sworn in in January.  It is now the eve of October. In the seven months since the Irish kid became President, one would imagine that the divisive partisan discourse of the presidential campaign would have diminished in volume and level of vitriol, save for the utter loons at both extremes of what passes for the political spectrum.</p>
<p style="text-align:left;">Sadly, our imagination cannot match the weapons-grade wackiness of political reality in the US.</p>
<p style="text-align:left;">Unable to accept the sound thrashing they suffered in the polls, many people immediately began the stages of grief. Unfortunately, few of them have managed to move past the &#8220;Denial&#8221; phase. Rather than admit that their message (such as it was) and chosen standard-bearers were not acceptable to a majority of the electorate, the right fringes of the conservative side began denouncing the President for his alleged lack of Constitutional eligibility for the office. Despite proof provided by unbiased, trustworthy sources, these moonbats are <em>still</em> bitching and griping about Obama&#8217;s eligibility. I&#8217;m reasonably certain that the same people refusing to accept evidence which contradicts their delusions today are the same people who repeatedly urged the left fringe moonbats to accept the evidence of Dumbya&#8217;s 2000 election. If the plan was to expose their own hypocrisy, the right-wing nutjobs are doing a heckuva job.</p>
<p style="text-align:left;">Armed with a commanding majority in the Legislative branches and a Democratic President, the Left should have had a fairly easy time of things. This does not take into account the Democrats&#8217; traditional aptitude at shooting themselves in the foot, however. When Democrats began trying to rush a whole raft of bills through Congress in support of their agenda, they managed to totally alienate many of their own party members and a large number of citizens. When those citizens started asking questions of their elected representatives (starting with, <em>what&#8217;s the rush?</em>), the Democratic response was stereotypically boorish. First came the haughty &#8220;<em>Mother knows best, dear</em>&#8221; replies, which alienated everyone even more. When public outcry became more organized, the Democratic leadership tried to marginalize their own constituents by claiming the opposing voices did not speak for a majority of Americans. As it became clearer that a significant percentage of citizens were not, in fact, supporting the Democratic agenda, the Democrats started copying the Republican playbook from the last 8 years. To the surprise of no one but the Congressional leaders, calling their constituents <em>Nazis</em> and similar epithets did not dampen the increasingly vocal opposition to the Democrats&#8217; agenda.</p>
<p style="text-align:left;">This is mostly old hat to veteran watchers of the US political process. The more things change, the more they stay the same. After being on the outside for a decade or so, the Democrats immediately turned into their own worst enemies once they achieved power- just as the Republicans did starting in the mid-1990s.</p>
<p style="text-align:left;">What makes this tired cliche scary is that the frantic wingnuttery of the far right seems to have far too much control over the tattered remnants of the Republican party. Not content with the &#8220;birther&#8221; nonsense, some of the more vocal idiots on the red end of the spectrum are now publicly calling for the assassination of  President Obama and a military coup to overthrow the elected government of the United States.</p>
<p style="text-align:left;">When I took the Oath of Enlistment in the US Navy, I swore to &#8220;support and defend the Constitution of the United States against all enemies, foreign and domestic.&#8221; Even though I no longer wear my country&#8217;s uniform, I still consider myself bound by that oath. I refuse to allow a bunch of sore losers- from either party- bring down ruin upon my country. Those of us who are not rabid political ideologues must immediately, publicly, and loudly make it clear to the vermin calling for the death of the President or the military overthrow of our legally-elected government that such language will not be tolerated. Anyone who commits treason, as these right-wing ass-hats seem to be doing, should be prosecuted to the fullest extent of the law. Immediately. These people are actually worse than the Islamic Fundamentalist lunatics we have been fighting for the last eight years. Their words and actions are creating a clear and present danger to the safety of the Republic.</p>
<p style="text-align:left;">Therefore, they are  the enemies of the United States of America, because they are striving to destroy the Constitution of the United States. They are <em>my</em> enemies.</p>

In the apparently never-ending quest by the religiously stupid to destroy our civilization, a new voice has appeared in the wilderness. Judging by <a href="http://www.amazon.com/Reason-Reasons-Theology-Twenty-First-Century/dp/0567028305/ref=sr_1_1?ie=UTF8&amp;s=books&amp;qid=1252949911&amp;sr=1-1" target="_blank">this moron&#8217;s</a> <a href="http://fish.blogs.nytimes.com/2009/09/14/does-curiosity-kill-more-than-the-cat/?ref=global-home" target="_blank">screed against curiosity</a> (reported in the <a href="http://www.nytimes.com/" target="_blank">New York Times</a> Opinion pages), one may safely assume Duke University qualifies as a wilderness.</p>
<p style="text-align:left;">According to Paul Griffiths, professor of Divinity at Duke University, curiosity is a vice. One is tempted to inquire as to how someone without curiosity was able to earn a PHD, but that would probably be unkind and unfair. It is profoundly unfair to make fun of the senile and incontinent dotards among us, or so I am assured by my supervisor at work and the empty suits spewing garbage disguised as journalism on television.</p>
<p style="text-align:left;">So let us leave aside questions about the Professor&#8217;s mental capacity and degree of hypocrisy and concentrate upon his message: curiosity is a mortal sin. A quick perusal of search engine results for &#8220;mortal sins&#8221; brought me to a website about <a href="http://www.saintaquinas.com/mortal_sin.html" target="_blank">Thomas Aquinas</a>. Oddly enough, curiosity wasn&#8217;t mentioned, although the various &#8220;sins&#8221; listed in the linked page could probably be forced to fit.</p>
<p style="text-align:left;">Therein lies the problem with the god-deluded pinheads among us: They are willing- nay, eager- to warp and twist their own &#8220;sacred&#8221; texts in order to force others to stop doing something which which the religiously indignant disagree. They never cry out against their own failings. Rather than following the teachings of their founders, those afflicted with the religion virus are determined to root out the motes in our eyes while ignoring the twenty-story cathedrals constructed from the beams in their own.</p>
<p style="text-align:left;">Ignorance is not bliss. The ignorant religious individual may in fact be blissful, but their contentment comes at the price of being raging dickheads to everyone not willing or able to violently campaign against the recognition of the real world about them. Some of Professor Griffith&#8217;s fellow religionists claim religious discrimination when they are prevented from discriminating against those with other religions (&#8220;<em>We must punish the heretics for their blasphemy!&#8221; &#8220;Sorry, bub. Can&#8217;t let you do that.&#8221; &#8220;Why are you <strong>oppressing</strong> me?&#8221;</em>). Their blissful ignorance is a plague upon our technological civilization. The religious are content to say, &#8220;<em>I do not understand this, therefore it must be the work of God</em>.&#8221; Fair enough. If you don&#8217;t want to learn more about our universe, that&#8217;s your privilege.</p>
<p style="text-align:left;">Unfortunately, this is not good enough for the god-botherers. Since they are too intellectually lazy to actually think, they demand that no one else be permitted to think, either. Given the power to do so, far too many supposedly god-fearing men and women would happily return all of humanity to the golden age of religious barbarism from millennium ago. &#8220;<em>How dare you say that the Earth revolves around the sun?&#8221; &#8220;Sorry, bub. The evidence we&#8217;ve gathered shows pretty clearly &#8230;&#8221; &#8220;Blasphemy! Evidence means nothing when in conflict with the word of God! Burn the heretic!</em>&#8221; When these dolts are regularly (and properly) ridiculed and derided because their anachronistic and autocratic demands bear no relation to consensus reality, they all too often set about trying to force reality into the grim little mold of their paranoid and archaic fantasies. In doing so, the religiously deluded manage to cause a great deal of harm to the society in which they reside. Sometimes they cause harm by destroying public discourse with their shrill refusal to accept anything less than total subjugation of the laws of physics to their nonsensical whims. Sometimes they do harm by infecting the political process of their home countries. Worst of all, some resort to violent action to destroy anyone who denies their faith.</p>
<p style="text-align:left;">I propose we wall off a portion of the planet- some relatively small, dismal, and unpleasant land which nobody really wants. Set armed guards about the place, to prevent the inmates from escaping. Any True believer who so desires may choose to enter this Reservation at any time after reaching voting age to practice his or her religion to their hearts&#8217; content, but they will never be permitted to leave. Crusades, pogroms, jihads, infanticide, whatever they want to do to one another in the Reservation will be no concern to anyone on the outside. The rest of the planet can continue learning and growing, while the deity-diddlers can either shut up and go along for the ride or go to the Reservation for life.</p>
<p style="text-align:left;">Note that no one would be forced into Coventry for their beliefs. Anyone who wants to believe in a god or gods without trying to foist their delusions upon their neighbors will be permitted to join the rest of the world as we develop a better understanding of the universe. <p style="text-align:left;">This is not discrimination. This is self-defense. The religious pinheads are actively trying to destroy our civilization in favor of their theocratic despotism, and they aren&#8217;t even trying to conceal this. One of the candidates in the last US Presidential election publicly said he wanted his holy book to be the supreme law of the land, for just one example. These people have made no secret of the fact that they want to force everyone in this country to believe as they do- in every repellent aspect, and are therefore committing treason. They are the enemies of freedom, and the enemies of anyone who wants to think freely. I, for one, refuse to submit to the supposed mercies of religious zealots. Anyone who wishes to believe in a deity is free to do so until they try to force their beliefs on me. At that point, the religious dickheads have made themselves my enemy, to be dealt with as wolves are.</p>

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p style="text-align:left;">As I write this, the nation is opening a new front in the (long-since lost) War on Drugs™. The Federal Gummint, along with a few local and state jurisdictions, have apparently decided that we (the People) cannot be trusted with pseudoephedrine.</p>
<p style="text-align:left;">For those of you not familiar with this over-the-counter drug, pseudoephedrine (brand name <em>Sudafed</em>) is a decongestant- a non-addictive chemical which dramatically helps with sinus congestion. It has been issued over the counter for decades because of its efficacy and lack of side effects. For millions of people with allergies, colds, flu, or chronic sinus problems, this inexpensive drug is a boon beyond price.</p>
<p style="text-align:left;">Unfortunately for those sufferers, the Gummint (in typical <em>mama knows best dearie</em> form) wants to make pseudoephedrine in all its guises available by prescription only. Not because of some recently-discovered side effect wherein the user is transformed into radioactive iguanas or might be prone to wandering bladder syndrome followed by catastrophic explosions. No, the Gummint (<em>we only have your best interests at heart</em>) is doing this (<em>for your own good, of course</em>) because some people might use it to make meth.</p>
<p style="text-align:left;">Never mind that ordinary citizens already have to show identification before purchasing this dangerous product. Never mind that such laws have had no measurable effect (in Oregon, for example, where this is already state law) on the production of meth anywhere. Never mind that pseudoephedrine is no longer strictly required to make meth anymore (there is a fast, cheap, and dirty method of making the vile stuff in a 2-liter soda bottle which does not require any pseudoephedrine-containing products). In a classic case of padlocking the barn door long after the horses have escaped, the Gummint is bound and determined to &#8220;do something&#8221; about the &#8220;meth epidemic&#8221;. In a typical Gummint frenzy to <em>appear</em> to be accomplishing <em>something</em>, this inexpensive drug may soon be only available with a doctor&#8217;s prescription. I assume the Gummint&#8217;s next smooth move will be to outlaw common household chemicals (such as baking soda) to combat meth, and perhaps potting soil to combat the &#8220;scourge&#8221; of marijuana.</p>
<p style="text-align:left;">Let&#8217;s take a look at the probable consequences of this action: A drug that anyone can now pick up at any grocery store or drug store for about six dollars will now only be available after paying a doctor upwards of fifty dollars for an office visit. Because the common, inexpensive drug must now be carried in the security of a drug store safe and only dispensed by licensed pharmacists, the cost per unit will have to be raised (to pay for the additional paperwork, among other things). Law-abiding citizens stricken with sinus headaches, allergies, or sinusitis will now have to wait until they can be seen by a doctor before getting any relief at all. The best part of the whole plan, of course, is that this will have almost no measurable effect on the production and sale of meth. The only possible real effect on meth production this might have would be to reduce production by local meth-heads and increase production by Mexican drug lords. By all means, let us create a new revenue stream for the narcolords south of the border. After all, those stalwart, law-abiding <em>hombres</em> would never <em>dream</em> of violating US laws.</p>
<p style="text-align:left;">This asinine drug war has to stop. We (the People) need to be smart enough to recognize a lost cause when we get beaten over the head with it day after day. Criminalizing common items in a demonstrably vain attempt to prevent people from getting high (or low) is having the effect of militarizing our police forces, creating a crippling number of overcrowded prisons, and fueling the drug violence in Mexico with billions of our dollars. We&#8217;ve gone this route before with Prohibition, and look how well that turned out. Seriously. Look at how Prohibition turned out. The parallels are staring us in our collective face, but we (the People) are seemingly unable to accept the stark reality of this War on Drugs™. Legislating puritanism does not work in a free society.</p>
<p style="text-align:left;">One of the people at the Centers for Disease Control was interviewed about the so-called &#8220;Crack Epidemic&#8221; of the  80&#8217;s by P.J. O&#8217;Rourke for his book, <em>Parliament of Whores</em> (published in 1991). This worthy forecast that the &#8220;crack epidemic&#8221; would be mostly over in about ten years because most of the crack addicts would be dead by then. This was entirely accurate, if politically incorrect.</p>
<p style="text-align:left;">Let us stop criminalizing so-called &#8220;dangerous drugs&#8221; and start criminalizing dangerous behavior. This is similar to what we are doing with alcohol in the wake of the failed experiment in national puritanism called Prohibition. We criminalized the behavior, not the substance. All we (the People) need to do is extrapolate existing laws to cover dangerous behaviors which are already illegal- such as driving under the influence. Drive while stoned or drunk, spend a  year in jail, mandatory. Cause damage to people or property while stoned or drunk, double that. Kill someone while stoned or drunk, life in prison without parole (or death, if your state allows this). Pretty soon, those without the self-discipline to enjoy their drug of choice at home will all be dead or in prison. This idea has the advantage of being far cheaper than the current War on Drugs™, but would also strangle the flow of cash to the drug lords in Mexico. Taxing the various recreational pharmaceuticals will be problematic for a considerable time, but the huge cost savings from not funding the attempts to win an unwinnable &#8220;War&#8221; should really be enough of an incentive to try this. Any tax revenue raised would be pure profit for the Gummint, compared to the hundreds of billions of dollars currently being poured down a rat-hole every year for no appreciable gain.  It also has the enormous advantage of being far more friendly to liberties of the individual citizen.</p>
<p style="text-align:left;">Any one of these advantages ought to be enough to convince people to end this wasteful War on Drugs™. Sadly, I fear far too many of my fellow Americans- on both sides of the political spectrum- are uninterested in rational decision making or logical choices. Those on the left might claim to be appalled at the callous disregard for the lives of the addicts, while those on the right might claim to be outraged at the idea that someone might be enjoying himself outside of their idea of &#8220;proper behavior&#8221;, but they&#8217;re both just trying to disguise their desire to control others.</p>
<p style="text-align:left;">Here&#8217;s a lovely quote from Heinlein which seems appropriate:</p>
